Program: “What’s Really Going On in Patent Damages?” There is a lot of folk wisdom about what’s happening with patent damages, and some of this folk wisdom is currently involved in patent reform efforts in Congress, but how accurate is the folk wisdom? Academic researchers such as Kimberly Moore, now on the Fed Circuit, have long pointed out that data from FJC records are often missing or mis-coded; and that this is especially true for damages issues. Studies relying on these data can be, therefore, misleading – both for policy makers and for practicing attorneys. Dr. Lynde’s presentation will review the current state of damages trend analysis. Speaker: Matthew R. Lynde, Ph.D., Vice President, Cornerstone Research Dr. Lynde is an economist and a Vice President at Cornerstone Research. He has more than twenty-five years of experience as an applied economist in government, policy research, academic, and commercial environments. He served on the president’s Council on Wage and Price Stability and studied small firm growth and innovation policy at the Brookings Institution. Before joining Cornerstone Research, he was a partner at the global accounting and consulting firm of PricewaterhouseCoopers, where he headed up the firm’s economics practice and its Bay Area intellectual property litigation support practice. For more than 16 years, Dr. Lynde has focused on litigation support economics, especially in the areas of intellectual property infringement, including patent damages and licensing, antitrust and unfair competition, and securities fraud. He has served as the expert witness in a large number of cases in Federal and state courts, in foreign courts, and in arbitration. His cases tend to involve digital electronic machinery fabrication and applications, software, digital telecommunications, biotech pharmaceuticals and advanced medical devices.
