Speaker: Annette S. Parent, Ph.D., Partner, Townsend and Townsend and Crew LLP Program: Dr. Parent will provide an overview and summary of the case law for 35 U.S. 271(e)(1). This statute provides for a safe harbor from patent infringement for certain research-related activities for inventions that are subject to FDA approval, including medical devices and pharmaceuticals. She will also discuss the recent Federal Circuit case, Proveris Sci. Corp. v. Innovasystems Inc., that raises some new questions about the interpretation of this statute. Dr. Parent’s intellectual property practice emphasizes patent law and related matters, particularly in the field of biotechnology. She represents a range of clients, including academic institutions, start-up biotechnology and drug discovery companies, and large pharmaceutical companies. She has advised clients in many technical areas, including molecular biology, biochemistry, cell biology, neurobiology, and immunology. She assists clients with patent portfolio management, U.S. and foreign patent prosecution, due diligence reviews, freedom to operate analyses, validity/infringement opinions, and licensing. Prior to joining Townsend, Dr. Parent was a postdoctoral fellow at the Oregon Health Sciences University, Department of Cell Biology, where she was awarded an NIH fellowship for the study of neurotrophic factors.
